Ah Hao: to hang or not?

On 10th October 2004, 23-year-old Malaysian Took Leng How was found guilty of the murder 8-year-old China girl Huang Na. He was given the death sentence on 26th August 2005.

Last month, his appeal was rejected by the Court of Appeal.

Justice Kan Ting Chiu felt there was a reasonable doubt on Took's conviction for murder. He said Took should instead be convicted for voluntarily causing hurt, which carries a maximum jail term of one year of a $1000 fine.

However, Chief Justice Yong Pung How and Judge of Appeal Chao Hick Tin agreed with trial judge Lai Kew Chai that the Took was not suffering from an abnormality of mind at the time of the offence.

With a majority vote of 2-1, Took’s appeal was dismissed and it seems that Took (better known as Ah Hao) will face his execution after all, unless the President grants him clemency. The outcome of the clemency is expected to be released in six to nine months.

Even that comes as a slim chance. Over the 41 years since Singapore turned independent, only 6 criminals had their death penalty amended to life imprisonment.

Ah Hao’s father, the older Mr Took, started a petition drive in Singapore on the day when the appeal was rejected. Before he left for Penang, about 30 people have signed it.

He left some petitions with helpful Singaporeans, most of whom were strangers, hoping to get as many signatures as possible to ask the President to spare his son’s life.

The Malaysian newspapers reported that Mr Took has since received thousands of signatures in Penang.

Till now, Mr Took still believes that his son is innocent and he claimed, "If he is guilty, why did he not run away and hide when he had the chance the last time? Why did he turn himself in? He told me he did not do it, and I believe him."

The sacrifices Mr Took has made and the faith he still has for a "dying" son, are heart-wrenching demonstrations of the love a father has for his son.

This has made many Singaporeans sympathize with Mr Took’s plight and in turn feel sorry for Ah Hao. Some also hope that he would not have to die, so that one day he would have the chance to reunite with his parents, wife and young son.

The opposition voices then rang out, "What about Huang Na who died such a tragic death at a young age? Her life ended so abruptly when she did nothing wrong. Justice will only be met if her murderer is hanged."

I am not a judge nor a lawyer, and I do not know any of the involved parties in this case. I can only view this matter from the eyes of a plain member of the public.

It does not seem fair to sympathize with a criminal, just because his family feels that he is innocent and does not want to see him head for execution. Neither does it seem right that another person has to die just because someone died in the crime.

Huang Na has died a tragic death, we do not want to see another party lose his life, that is if he is indeed innocent of murder, but only guilty of manslaughter.

It is indisputable that Ah Hao led to the death of Huang Na, but what is of interest in this case is that, whether Ah Hao killed Huang Na remains a debatable issue.

Justice Kan questioned whether the girl's death was caused by Took smothering her mouth and nose, or if she died as a result of a fit. The forensic scientists could not tell for sure, even the judges at the Court of Appeal stood divided on this issue.

The other day, a colleague asked me if I wanted to sign the "Ah Hao petition".

I gave it a thought, and made my decision.

I will sign the petition to plead for clemency. I was actually quite baffled why he was sentenced to death, even as prosecution is not able to prove beyond reasonable doubt he had indeed committed the murder.

Moving on, if Took is sentenced to death, who benefits? Huang Na in nether world, or her reportedly greedy parents?

I pity the young girl, I do. But it is still doubtful whether Took murdered her. For justice, jail term for manslaughter, yes. But death for murder, I'm not sure.

If he did not murder the young girl and got sent to the gallows, what about the justice to him?

If Took is not sentence to death, his father, his son, his wife, his family get to see him, even in jail. They don't lose a son to a murder case which cannot be proved beyond reasonable doubt.

I think most of us just go by our emotions. We formed our views only from media reports.

How many of us have sat through all the days and hours at the court, seen all the exhibits or observed the behaviour and body language of the accused. I think the original judge is the best person to decide.

If Took is sentenced to death, who benefits?

This argument is rather absurd. In that case no one should be sentenced to death even if he kills a whole family.

My own personal feeling is that he did it to silence her.

Let the decision by the appeal court prevail or now let the president decide.

I would say don't bother with petitions in this case. Many people sign for the reason stated by qa. Some may have negative views of Huang Na's mother (greedy for example as someone said) and they will sign anything that is against her.

Wonder why you put up this post.

I think I will sign the petition, although I don't think that our President will be influenced easily from his decision by a mere piece of paper with signatures.

But based on whatever facts presented in the papers, I do not think there is sufficient evidence to prove beyond reasonable doubt that Ah Hao killed Huang Na with a murderous intent. Manslaughter more likely.

Why the need to mention greedy parents?

Even if it is true, does it justify the girl's dealth or that the accused should be freed?

I think it is injustifiable to say that Took should not be sentenced to death just because his death would not bring Huang Na alive. If that is so, all murderers would go scot free.

I am not showing support for the petitions, but I feel that if the prosecution is not able to prove beyond resonable doubt that Took killed Huang Na, then perhaps he deserves a re-trial.

Why not just say you sign or not, like scared harm will come to you if you state your stand. Nothing wrong if you support the petition.

My interpretation is that you support the petition:-

There is no need for this posting if you are neutral or are for the court's decision.

If you just want to give your view, there is no need to mention the petitions here and in Penang.

To anonymous: It's her blog. Who are you to judge whether her postings are necessary or not? Everyone is entitled to his/her own opinions.

And why not just identify yourself instead of using an anonymous nick? like scared harm will come to you if you write out your name.

No need for you to defend her. She is a journalist, she will explain if she feels the need to. You may make things worse for her.

bummer, I'm anonymous3, I think you have difficulties understanding what I wrote. Please ask someone.

First, it is about this posting only and not all her postings.

Second, it is not about this posting is necessary or not. I gave my reason for her posting of this article - the fact that she posted this and the way she wrote it shows that she support the petitions.

Don't forget others are also entitled to their opinions

Your identity, as mentioned is none of any one's business, so is her stand.

Why should you care if she signed the petition or not? By stating it, so that you can flame her more?

You and I, too blog-hopped to this place, so why be so harsh on someone we totally don't know.

Your opinion is appreciated, why you don't deserve to question her intention or integrity, you don't know her. But from what you wrote, you definately have no idea where your stand is. And you are making a fool of yourself.

I wouldn't exactly think of that as a ridiculous reason.

He ran, came back and stand trial bcos he thought he mite have a chance. And through the trial, some of us thought that the evidence was not strong enough to prove he murder with an intention to do so. Maybe he himself thought so, that's why he came back to Singapore.

You should try looking at the whole picture.

i read this to mean: he decided to give himself up so he has a conscience. Therefore he should be spared.

Im watchin the interview now at channel newsasia.maybe repeat trlecast. I nearly cried so pitiful. I cried for Mr Took.he died for nothin.i still don understand why he hanged.he is totally innocent. i dont believed he s the killer...cannot be him. He just the scapegoat for the greedy. Yeah no motive he wan to kill her.he atill got tat kind of childishness and simple. Why did he came back to spore whereas he free...did anything or anyone lured him back...maybe he is not tellin the truth abt the whole situation...seems hiding info. He is not cunning or manipulative no wander he didnt survive...really pitied him...after watchin the documentary i can feel he so innocent n nvr understand why he s hanged. Yeah he already give himself up so why killed him. We shld hv donated to his family n not to the mum tat living in luxury..haha jus my thought after reading the story.
